Martin Fell from Thompson Solicitors who advocated McCulloch’s case in an out of court settlement said that unfortunate incidents like these are a grim reminder of the carelessness of employers in ensuring the safety of their workers. Had the door been properly inspected, McCulloch would never have had to suffer such a trauma, he said.
David McCulloch was delivering burger buns to the Burger King outlet at Newmarket when the door of his van suddenly slammed shut on the unsuspecting driver. His fingers unfortunately had to bear the brunt of the malfunction.
The Burger King staff tried to help him out of his misery, but failed. Eventually, the fire department arrived at the scene and with the help of their sophisticated cutting equipment freed McCulloch.
